To effectively promote government transparency, practice transparent administration, and standardize the engagement of assessment agencies for mineral rights transfer fees, in accordance with the "Opinions of the General Office of the CPC Central Committee and the General Office of the State Council on Carrying Out Special Rectification Work to Combat Commercial Bribery" and the "Ten Measures for Administration Serving the People and Five Prohibitions for Staff Members in the Land and Resources Management System," after careful deliberation, it is hereby decided that, for prospecting rights and mining rights approved for paid transfer by the Henan Provincial Department of Land and Resources after February 1, 2007, the assessment of such mineral rights shall be entrusted to assessment agencies publicly selected by the Henan Provincial Department of Land and Resources. The relevant details are hereby announced as follows:
1. In the first week of odd-numbered months, the Department of Natural Resources and Land of Henan Province will publish proposed appraisal projects on the “Mineral Rights Appraisal” webpage of its portal website, along with specific appraisal conditions and requirements. In special circumstances, the frequency of publishing proposed appraisal projects on the webpage may be increased.
II. Assessment agencies meeting the following conditions may register within 5 working days after the assessment project is announced:
1. Possesses qualifications for mining rights valuation;
2. Has not been subject to administrative penalties or industry self-regulatory sanctions in the past two years;
3. The principal appraiser shall have more than 3 years of appraisal experience and shall have engaged in the appraisal of mining rights for the same or similar mineral types (supporting documentation of actual performance required).
4. Other conditions that meet the requirements of the assessment project announcement.
Registration can be done via letter, email, fax, or other means; specific details are posted on the mineral rights appraisal webpage.
Within three business days after the registration deadline, the Department of Natural Resources and Land of Henan Province will publish the list of appraisal agencies that meet the registration requirements on the mineral rights appraisal webpage.
3. Five working days after the list is published, a public lottery will be conducted to select and appoint appraisal agencies. Representatives from the Henan Provincial Department of Natural Resources and the appraisal agencies will supervise the process on-site. The lottery results will be announced immediately and also posted on the mining rights appraisal website.
4. The selected appraisal agency shall sign the appraisal contract with the Department of Natural Resources and Planning of Henan Province within 5 working days after receiving the written notification of the selection results. If the agency decides to waive its commitment to undertake the appraisal project, it must notify the Department of Natural Resources and Planning of Henan Province in writing within 3 days of receiving the notification. The Department of Natural Resources and Planning of Henan Province will not accept any further applications from this agency within six months. They have been invited to apply for candidacy. The evaluation projects that were abandoned will be postponed and entrusted to the next selection of evaluation agencies.
V. For mineral rights appraisals conducted through competitive bidding, the Henan Provincial Department of Natural Resources and Planning shall be responsible for providing the required key geological reports and relevant materials. For mineral rights appraisals approved for transfer via agreement, the applicant shall provide the following materials:
(1) Geological reports (or mineral reserve verification reports) at or above the level of a formal census compilation;
(2) The review opinion letter from the mineral reserve evaluation agency;
(3) Undertaking on the Authenticity, Completeness, and Latest Findings of Geological Data.
For applications for mining right assessments, in addition to the aforementioned materials, an approved development and utilization plan must also be provided.
Other materials required for the assessment will be collected and supplemented by the assessment agency.
6. The appraisal fees for mining rights transfer projects conducted by the Department of Natural Resources and Planning of Henan Province shall be borne by the Department of Natural Resources and Planning of Henan Province.
