Exclusive Economic Zone and Continental Shelf Exploration and Development

7. Exploration and development activities of natural resources in China’s exclusive economic zone and continental shelf, or drilling for any purpose on China’s continental shelf, must be approved by the Chinese government.

(Four)

Oil and gas extraction

8. The exploration and development of oil and natural gas (including unconventional hydrocarbons such as oil shale, oil sands, shale gas, and coalbed methane) are restricted to joint ventures and cooperative arrangements.

Rare earth and rare mineral mining and beneficiation

9. Investment in rare earth exploration, mining, and ore dressing is prohibited. Without prior authorization, entry into rare earth mining areas or acquisition of mine geological data, ore samples, and production process technologies is also prohibited.
10. Investment in the exploration and mining of tungsten, molybdenum, tin, antimony, and fluorite is prohibited.
11. Investment in the exploration, mining, and ore dressing of radioactive minerals is prohibited.

Mining and beneficiation of metallic and non-metallic minerals

12. Exploration and mining of precious metals (gold, silver, and platinum group metals) are classified as restricted activities.
13. Lithium mining and ore dressing are classified as restricted activities.
14. Graphite exploration and mining are classified as restricted activities.

III. Manufacturing

Mineral smelting and rolling processing

26. The smelting of rare metals such as tungsten, molybdenum, tin (excluding tin compounds), and antimony (including antimony oxide and antimony sulfide) falls under the category of restricted industries.
27. Rare earth smelting and separation are classified as restricted activities, permitted only through joint ventures or cooperative arrangements.
28. Investment in the smelting and processing of radioactive minerals is prohibited.

X. Scientific Research and Technical Services Industry

Professional technical services

87. Investment is prohibited in the following activities: geodetic surveying, marine surveying, aerial photogrammetry for mapping, surveying of administrative boundary lines, preparation of topographic maps, world political maps, national political maps, provincial-level and lower political maps, nationwide educational maps, local educational maps, and true 3D map compilation; the preparation of navigational electronic maps; as well as regional geological mapping, mineral geology, geophysics, geochemistry, hydrogeology, environmental geology, geological hazard assessment, and remote sensing-based geological surveys.
88. The surveying and mapping company is classified as a restricted type and must be controlled by the Chinese side.
89. Investment in human stem cells, as well as the development and application of gene diagnostic and therapeutic technologies, is prohibited.
90. The establishment and operation of institutions for humanities and social science research are prohibited.

All industries

120. You may not engage in business activities as an individual industrial and commercial household, a sole proprietorship investor, or a member of a specialized farmer cooperative.
121. The prohibited categories in the “Guidance Catalog for Industries with Foreign Investment” and those marked with “ Limited to joint ventures ”、 “ Limited to cooperation ”、 “ Limited to joint ventures and cooperation ”、 “ China-controlled ”、 “ China holds a relative controlling stake. ” For projects with requirements regarding the proportion of foreign investment, it is prohibited to establish foreign-invested partnership enterprises.
122. For foreign investors’ mergers and acquisitions of domestic enterprises, strategic investments by foreign investors in listed companies, and contributions made by overseas investors using equity interests they hold in Chinese enterprises—where such transactions involve foreign-invested projects as well as the establishment and amendment of enterprises—procedures shall be carried out in accordance with current regulations.
