In recent years, China’s mining market has experienced a downturn and significant adjustments alongside the global economic situation. Coupled with China’s economy entering a “new normal” and the ongoing supply-side reforms, Chinese mining enterprises are currently facing severe challenges. In February 2016, the State Council successively issued guidelines on capacity reduction in the coal and steel industries, while eight major government departments—including the People’s Bank of China—also released the “Several Opinions on Financial Support for Stabilizing Industrial Growth, Adjusting Structure, and Enhancing Efficiency.”

        Mining enterprises are struggling to move forward in an external environment characterized by a prolonged “winter,” with disputes and conflicts cropping up one after another and a growing number of complex and contentious issues emerging continuously. Moreover, China’s current Mineral Resources Law, enacted in 1996, has remained unchanged for nearly two decades, seriously lagging behind actual mining practices and highlighting the growing disconnect between law and practice. Consequently, the interpretations provided by the Supreme People’s Court in individual case hearings—and the resulting judicial precedents—carry significant practical guiding value.
