The “Administrative Measures for the Deposit for the Governance and Restoration of Geological Environment in Shaanxi Province’s Mines” will come into effect on June 1. Newly established mines must submit a Mine Geological Environmental Protection and Governance & Restoration Plan, as well as a Commitment Letter for the Governance and Restoration of the Mine’s Geological Environment, before commencing production.
To protect the geological environment of mining areas, the “Administrative Measures for the Deposit for the Governance and Restoration of Geological Environment in Shaanxi Province’s Mines” will come into effect on June 1. Newly established mines must submit a Mine Geological Environmental Protection and Governance & Restoration Plan, as well as a Commitment Letter for the Governance and Restoration of the Mine’s Geological Environment, before commencing production.
It is understood that the mine geological environment remediation and restoration deposit refers to funds deposited by the mining right holder to fulfill its obligations for the protection, remediation, and restoration of the mine’s geological environment. Even if the mining right holder has deposited such a guarantee, it still remains obligated to carry out the remediation and restoration of the mine’s geological environment. Before commencing production, newly established mines shall submit a mine geological environmental protection and remediation plan as well as a commitment letter for the remediation and restoration of the mine’s geological environment.
The regulations stipulate that the amount of the security deposit to be stored shall be determined based on factors such as the approved mining type, mining scale, duration of operation, and the impact of mining activities on the geological environment. For mining licenses with a validity period of less than five years, the mining right holder shall deposit the full amount of the security deposit in one lump sum. For mining licenses with a validity period of more than five years but less than ten years, the initial deposit amount shall not be less than 30% of the total amount required. If the mine reclamation is completed in one go and passes the acceptance inspection, the mining right holder may withdraw 90% of the security deposit. If the mining right holder fails to deposit the security deposit on time, the administrative department for land and resources shall order it to make the deposit within a specified time limit and impose a fine of no more than 30,000 yuan. In cases where the mining right holder fails to fulfill its obligation to carry out reclamation and restoration, or where the reclamation and restoration project fails to pass the acceptance inspection, the accepting authority shall issue a notice of rectification requiring the mining right holder to complete the reclamation and restoration of the mine's geological environment within a specified time limit.
