The Ministry of Commerce issued a notice stating that, in accordance with relevant laws and regulations including the Export Control Law of the People’s Republic of China, and in order to safeguard national security and interests and fulfill international obligations such as non-proliferation, it has decided to strengthen export controls on certain dual-use items destined for the United States. First, exports of dual-use items to U.S. military users or for military purposes are prohibited. Second, in principle, licenses will not be granted for the export to the United States of dual-use items related to gallium, germanium, antimony, and ultra-hard materials. For graphite-based dual-use items exported to the United States, stricter reviews will be conducted regarding both the end-user and the intended end-use. The notice takes effect officially from the date of its publication. It is reported that the content of this announcement differs from the previous two rounds of export licensing controls imposed on related dual-use items: this time, the restrictions directly prohibit the export of these materials for U.S. military purposes, or subject such exports to stringent review.
