In recent years, the corporatization reform of law firms has become a prevailing trend. As law firms grow in size—both in terms of staff numbers and business revenue—to a certain scale, adopting the beneficial systems and practices of corporate management can facilitate the division of labor and collaboration between business operations and management, promote specialization and enhance efficiency, and ultimately help build brand recognition based on specialized expertise. By definition, a corporate-style law firm is one whose organizational structure, ownership structure, management model, and liability arrangements all comply with the requirements of corporate law. This enables the firm to establish organizational, accountability, management, operational, and distribution mechanisms that meet corporate standards, thereby creating a modern corporate system characterized by clear property rights, well-defined responsibilities, and scientifically sound management practices—and thus driving the scaling-up, standardization, and professionalization of law firms. So, having moved away from the traditional master-apprentice model, how can law firms forge an innovative path for training young lawyers?
The importance of lawyer training.
An intrinsic requirement for enhancing lawyers’ professional competence and personal cultivation. The legal profession is one that places the greatest emphasis on the integration of theoretical knowledge with practical experience, continually engaging in professional learning, training, and skill enhancement. At the same time, various aspects of a lawyer’s personal character—such as personality, temperament, interests, taste, and refinement—also play a crucial role in their individual development. Generally speaking, well-known lawyers in society all possess high levels of professional competence and distinctive personal charisma; conversely, lawyers who lack both professional ability and personal cultivation will ultimately be weeded out by the market.
Strengthen the standardized construction of law firms, and shape and enhance their image. “ Legal Services Brand ” the fundamental requirements. A legal service brand refers to the level of recognition and symbolic perception that consumers have of legal services—representing a concentrated manifestation of the market value of legal services. From a market-service perspective, the branding of legal services is not merely about the visibility of the legal service products themselves, nor simply about the renown of the individual lawyers and service teams providing those legal services; rather, it is primarily centered on the law firm itself. “ Name ” Its own fame lies in... “ Find a law firm ” , rather than “ Find a lawyer ” The fundamental purpose of training work is to strengthen the building of the lawyer team, enhance lawyers’ professional competence, ensure high-quality legal services, standardize lawyers’ continuing education activities, foster a positive learning environment, and provide clients with even better legal services.
This represents an important preparatory step for achieving specialized division of labor within law firms and for tapping into the high-end legal services market. Looking at the development of lawyers in Shaanxi Province, according to the "Report on the Overall Status, Major Issues, and Basic Approaches for the Construction of Law Firms in Shaanxi Province" issued by the Guidance Committee for Law Firm Construction under the Shaanxi Lawyers Association, the pillar businesses of Shaanxi’s law firms are predominantly traditional civil and commercial matters, with legal advisory services and criminal defense accounting for a significant share, while administrative representation, social services, and foreign-related business occupy a relatively secondary position. The professional focus of Shaanxi’s lawyers is mainly concentrated in areas such as real estate, finance, criminal defense, construction engineering, and capital markets. By contrast, high-end services like insurance, intellectual property, investment and mergers & acquisitions, corporate IPOs, fund establishment, private equity, and securities remain relatively scarce. Currently, our province’s legal services sector primarily revolves around litigation and traditional legal advisory services. There is still considerable room for improvement in areas such as regional development strategies, industrial restructuring, non-litigation mediation, implementation of major projects, enterprise restructuring, ecological and environmental protection, and foreign-related services. In this context, while maintaining and enhancing our traditional litigation and legal advisory services, it is of strategic significance to strengthen professional training, seize new historical opportunities presented by reform and development, explore new fields, and gain a foothold in the high-end legal services market.
The foundational guarantee for the proper development of the legal profession. According to... 2007 The Ministry of Justice’s “Opinions on Strengthening Lawyers’ Training” for the year and 2012 In accordance with the instructions and requirements of the “Guiding Opinions on Further Strengthening the Training of Young Lawyers” adopted at the 4th Executive Council Meeting of the 8th Session of the All-China Lawyers Association, we must correctly recognize the political significance of training work, intensify education on lawyers’ professional ethics and practice discipline, and further implement training initiatives effectively. The document points out that our country has entered a new stage of development characterized by comprehensively building a moderately prosperous society and accelerating the advancement of socialist modernization. This new situation places new and higher demands on lawyers’ training work. We must, from the perspective of serving the overall interests of the Party and the country, from the standpoint of building a socialist legal system with Chinese characteristics, and from the broader perspective of achieving high-quality and rapid development of China’s legal profession under the new circumstances, adapt to the requirements of these new situations and tasks, attach great importance to and earnestly strengthen lawyers’ training efforts, and ensure that China’s legal profession continues to develop in the right direction. Among young lawyers, we must vigorously enhance— “ Strictly abide by the law, uphold integrity, perform duties diligently and responsibly, and safeguard justice. ” Focus on education in lawyers’ professional ethics and practice discipline, guiding young lawyers to develop a correct professional mindset and promoting the spirit of the legal profession. Provide guidance to young lawyers on how to properly manage their relationships with judicial personnel and clients, and encourage them to be advocates, promoters, and practitioners of integrity within the legal profession, thereby establishing a positive image for the legal community. Educate and guide young lawyers to remain committed to serving the people through their practice, appropriately balancing economic interests with social benefits, and truly practicing law with integrity, responsibility, and in strict accordance with the law. In doing so, they will deliver high-quality and efficient legal services that effectively safeguard, uphold, and promote the fundamental interests of the people.
Characteristics of Training Work in Corporate Law Firms
Lawyer Training at the Firm: The training content is diverse, with a primary focus on lawyers’ professional expertise and skills development, supplemented by training in other areas of knowledge and skills. The main training method is through lectures delivered by heads of various practice departments or senior lawyers. Additionally, experts from outside the firm are invited to visit and engage in exchanges and discussions, combining both regular and ad-hoc sessions.
Training for trainee lawyers and newly practicing lawyers: The training methods should be diverse, emphasizing practicality and real-world applicability. The primary training approach will be simulated court trials, complemented by speech contests and debate competitions. The overall format should be lively and engaging, tailored to the characteristics of young lawyers.
In-house training within each professional department: Primarily focused on professionalism, practicality, and real-world applicability, and designed specifically to meet the internal training needs of each professional department.
Methods for Training in Corporate Law Firms
Establish training objectives that are tailored to the corporate management model of law firms. The training department of a law firm is responsible for both internal and external training programs for all practicing lawyers and trainee lawyers within the firm, serving as an indispensable component in enhancing lawyers’ professional competence. Training programs for lawyers should be designed with a focus on practicality and diversity, and conducted according to the specific needs and characteristics of different lawyer groups. While strengthening lawyers’ professional skills, these programs should also place equal emphasis on improving lawyers’ political awareness, professional ethics, and public image. Our goal is to bring the training program to a high standard within two to three years. “ Professionalization, practicality, and branding ” , build “ Training initiatives that enhance legal literacy and strengthen professional capabilities, uniquely tailored to the characteristics of corporate law firms. ”。
Conduct thorough research and widely solicit opinions and suggestions on aspects such as training content and delivery methods. In the initial stage of the work, the firm’s Training Department should distribute a “Training Survey and Opinion Solicitation Form” to the heads of all business departments, gathering information on training frequency and scheduling, the identity of trainers, and training content. For firm-wide lawyer training, the focus should be on common topics such as defense techniques, pre-trial preparation, evidence analysis, business development, and product innovation. For trainee lawyers’ training, emphasis should be placed on foundational and general knowledge training, coupled with practical exercises; the results of training assessments should serve as a reference standard for determining the salary grade of newly hired lawyers.
Plan and arrange the training work effectively.
Internal Training: Business training for all lawyers in the firm should combine regular and irregular sessions. The training will be conducted by heads of various practice departments or senior lawyers. We may also invite external experts, scholars, and legal professionals to deliver lectures, host symposiums, or engage in other diverse formats, covering topics such as professional image, business etiquette, and business presentation skills. Additionally, we can organize cultural salon activities—such as book clubs, debate competitions, speech contests, and film screenings—in collaboration with departments like the Youth League Branch, the Young Professionals Department, and the Women’s Work Department, thereby enriching lawyers’ leisure time and fostering the firm’s cultural development. For newly hired trainee lawyers and lawyers in their early stages of practice, the new employee training should focus primarily on four key areas. “ Understand and master ” (Law firm systems and regulations, history of law firm development, case-handling procedures, business etiquette for legal practice); simulation courts or debate competitions can also be organized to enable young trainee lawyers to genuinely experience the courtroom atmosphere, become familiar with trial procedures, and participate in real courtroom proceedings. The goal is to guide young lawyers through hands-on involvement. “ Show legal wisdom and inspire the brilliance of critical thinking. ” Internal training within professional departments, organized and conducted independently by each business unit, is best held once a month.
External Training: For nationwide or regional lawyer training programs, we selectively choose lectures or training workshops and send highly skilled lawyers to participate. Our firm also organizes large-scale lectures or forums, inviting leading scholars in legal studies, elite lawyers, and colleagues from sister law firms to attend. This approach not only enhances our lawyers’ external communication and exchange skills but also boosts our firm’s visibility and reputation.
Expanding Training Initiatives: Conduct a periodic, questionnaire-based survey of the firm’s training programs to evaluate their effectiveness and enhance training quality based on the survey results. At the same time, establish a dedicated training team and set up standardized training protocols within the firm, tapping into the full potential of lawyer training, standardizing the firm’s long-established training content, and developing a distinctive, internally recognized training model.
