Notice on Conducting Dynamic Supervision and Inspection of Mineral Reserves Across the Province

Recently, the General Office of the Ministry of Natural Resources issued the “Notice on Conducting Dynamic Supervision and Inspection of Mineral Reserves” (Guotu Zitingfa [2007] No. 67). We are now forwarding this notice to you. In preparation for the Ministry’s inspection, after careful deliberation by the Provincial Department, we have decided to launch a province-wide dynamic supervision and inspection of mineral reserves. We hereby notify you of the relevant matters as follows:
1. Attach great importance to this and conduct thorough self-inspections. The land and resources bureaus of each city must attach great importance to this inspection conducted at both the ministerial and provincial levels. The bureau directors in charge should personally take responsibility, organize staff to focus their efforts on conducting a comprehensive self-inspection within their respective bureaus, and prepare diligently for the ministerial inspection.
II. Inspection Content: The inspection shall be conducted in accordance with the “Notice from the General Office of the Ministry of Natural Resources on Carrying Out Dynamic Supervision and Inspection of Mine Reserves.” Two key points are emphasized: First, whether the annual report on mine reserves was included as a primary component of the annual inspection for mining enterprises in 2006. Second, each city—especially Xuzhou, Lianyungang, Nanjing, Zhenjiang, Changzhou, and Huaian—shall summarize and implement exemplary practices from one county (city or district) management authority, one geodetic survey institution, and one mining enterprise, and prepare written documentation thereof.
III. Inspection Methods and Schedule
This inspection adopts a combination of self-checks conducted by each city and on-site random checks by the provincial-level inspection team.
(1) Self-inspection. By June 10, the Land and Resources Bureaus of each city shall, in accordance with Document No. 67 from the General Office of the Ministry and the specific requirements set forth by the Provincial Department for this inspection, conduct a detailed, item-by-item comparison and verification. They should also carefully prepare relevant work summaries and compile these into written summary documents to be submitted to the Resource Division of the Provincial Department.
(2) Spot Checks. From June 10 to 30, the Department will organize inspection teams to conduct on-site spot checks of the work carried out by each city. The procedures for these on-site spot checks will follow those specified in Document No. 67 issued by the General Office of the Ministry. For cities designated as key mining areas, at least one county (city or district) land and resources administration department, one geodetic survey institution, and one mining enterprise will be selected for spot checks.

Notice on Conducting Dynamic Supervision and Inspection of Mine Reserves Management

Departments of Natural Resources of Provinces, Autonomous Regions, and Directly-Administered Municipalities (Departments of Natural Resources and Environmental Resources, Bureaus of Natural Resources, Bureaus of Natural Resources and Housing, or Bureaus of Housing and Land Resources):
In April 2006, the Ministry issued the “Notice on Fully Implementing Dynamic Supervision and Management of Mineral Reserves” (Guotu Zifa [2006] No. 87, hereinafter referred to as Document No. 87) and the “Notice on Strengthening the Collection and Management of Mineral Resource Compensation Fees and Promoting the Improvement of Coal Mining Recovery Rates” (Guotu Zifa [2006] No. 88, hereinafter referred to as Document No. 88), which provided comprehensive arrangements for the dynamic supervision and management of mineral reserves and set forth clear requirements regarding linking the collection of mineral resource compensation fees with the recovery rates of coal mines. Promoting dynamic supervision of mineral reserves plays an important role in implementing the State Council’s deployment on energy conservation and emission reduction, fostering resource protection and efficient utilization, and establishing economic mechanisms within mining enterprises that encourage the prudent and efficient use of resources. To summarize experiences, identify model cases, accelerate progress, and ensure the full establishment of a dynamic supervision system for mineral reserves by the end of 2007, the Ministry has decided to conduct inspections on the implementation progress of Documents No. 87 and No. 88 in each province (autonomous region, municipality). The relevant matters are hereby notified as follows:
I. Inspection Content
(1) Specific measures for implementing Ministry Documents Nos. 87 and 88. These include the basic information on the implementation plan, the status of drafting and revising relevant systems and technical standards, the coordination between dynamic monitoring of mine reserves and other tasks related to mineral resource administration (e.g., whether annual reports on mine reserves have been incorporated as a key component of annual inspections, and whether a joint review system has been established), as well as the division of responsibilities among provincial, municipal, and county land and resources management authorities.
(2) Progress of Work. Specifically, this includes the establishment of geological survey and measurement institutions in mines (such as the form and number of geologic survey institutions), as well as their operational status; the types of minerals and the number of mines subject to dynamic monitoring in 2006; the types of minerals and the number of mines planned for dynamic monitoring in 2007; the review of annual mine reserve reports and the results of on-site spot checks (including review methods, the number, proportion, and funding involved in spot checks); the verification of mining recovery rates at coal mining enterprises and the assessment of actual recovery rates; the implementation and effectiveness of linking compensation fee collection with recovery rates (including the number and proportion of mining enterprises whose recovery rates have been verified and assessed, the number of mining enterprises whose compensation fees were collected based on the determined recovery rate coefficients, changes in collection amounts, and analysis of underlying reasons).
(3) Typical Experiences. Specifically, this includes typical management models, exemplary experiences, and best practices. Each province (autonomous region, municipality) shall recommend at least one exemplary municipal or county-level administrative department, geodetic survey institution, and mining enterprise that have performed well in their work, and prepare written materials for each of these entities.
(4) Implementation of Documents No. 87 and No. 88 issued by the Ministry: Existing problems and recommendations.
II. Inspection Methods and Approaches
This inspection adopts a combination of self-inspection by each province (autonomous region, municipality) and on-site random checks by inspection teams.
(1) Self-inspection. By the end of June, the Department (Bureau) of Natural Resources of each province (autonomous region, municipality) shall, in accordance with the provisions of Documents Nos. 87 and 88 and the specific requirements of the Ministry for this inspection, conduct a point-by-point对照检查 and prepare relevant work summaries, culminating in the preparation of written summary materials.
(2) Spot Checks: The Ministry will form several inspection teams to conduct on-site spot checks on the work carried out in various provinces (autonomous regions and municipalities) from July to August. The on-site spot checks will be conducted through methods such as holding symposiums and visiting relevant units—including mining enterprises—to examine documents related to work arrangements, annual reports on mine reserves, and records and ledgers. In accordance with the requirements of Documents No. 87 and No. 88, the inspections will delve deeply into how land and resource management departments at all levels, mine geological survey institutions, and mining enterprises have implemented the relevant regulations. On this basis, inspection reports will be prepared, providing a comprehensive summary of each province (autonomous region and municipality)'s implementation of Documents No. 87 and No. 88 (including progress, outcomes, typical experiences, and existing problems), and putting forward specific requirements for further advancing this work. Each province (autonomous region and municipality) will be subject to spot checks covering at least one municipal or county-level land and resource management department, one mine geological survey institution, and one mining enterprise.
III. Division of Labor and Composition of the Inspection Team
Group One: Yunnan, Guizhou, Chongqing, Sichuan, Tibet;
Group Two: Shaanxi, Gansu, Ningxia, Qinghai, Xinjiang;
Group 3: Hubei, Hunan, Guangxi, Hainan, Guangdong;
Group 4: Anhui, Jiangsu, Shanghai, Zhejiang, Fujian, Jiangxi;
Group 5: Heilongjiang, Jilin, Liaoning, Tianjin, and Hebei;
Group 6: Shandong, Henan, Shanxi, Inner Mongolia, Beijing.
Each inspection team is led by a bureau-level or department-level official, with two to three additional members.
