Recently, the State Council issued the "Implementation Plan for Clearing and Standardizing Investment Project Filing and Approval Procedures" (hereinafter referred to as the "Plan"), outlining measures to further simplify and integrate the procedures for filing and approving investment projects.
The “Plan” clarifies that the approval procedures for investment project filings are administrative approval matters carried out by relevant departments and institutions—based on laws and regulations—prior to the commencement of construction, following the approval of the investment project application report or the reply to the feasibility study report. Any approval procedure lacking a legal and regulatory basis or not included in the list of administrative approval items retained by a State Council decision shall be abolished without exception. Even if such procedures have a legal and regulatory basis, but are no longer necessary to retain, they shall be abolished through legislative amendments. Approval procedures that can be addressed by soliciting opinions from relevant departments or by subsequent regulatory oversight shall also be abolished. For approval procedures that absolutely must be retained, efforts to optimize and integrate them should be intensified.
